#soe09: Jim Chisholm – the five myths affecting UK newspapers

Jim Chisholm took the stage at the Society of Editors conference this morning to counter some of the doom and gloom for the industry predicted by previous speaker Claire Enders.

Five myths currently circulating in the UK newspaper industry can be dispelled, argued Chisholm, joint principal of iMedia Advisory Services:

1) “We’re all going to die.”
2) “Journalism is omnipotent and UK journalism is better than its competitors.”
3) “The internet is everything – good and bad.”
4) “Newspapers are so powerful that they have to be controlled, restricted and regulated.”
5) “It’s all inevitable.”

  • “The Birmingham Post has been dead for 20 years (…) That paper has been a problem child for 20 years,” said Chisholm as an example. “But I don’t believe that 50 per cent of papers will be dead in five years time, it might be 10 per cent.”
  • “Newspapers’ circulation in this country can decline a long, long way before they become invaluable.”
  • Regional newspapers currently have a 11.3 per cent profit margin in the UK; nationals 8.2 per cent. Tesco’s profit margin is 8.2 per cent, but no one is predicting Tesco’s death, said Chisholm.
  • “This business doesn’t have a profit problem it has a debt problem.”
  • “UK newspapers are behind other markets in attracting digital revenues.”
  • “UK newspapers aren’t working together – phone up competitors quick and get working with them.”
  • “Go to the NLA and get them to have a single pricing mechanism, because I might pay for a service that gives me all of the newspapers together.”
  • “It’s true that fewer young people are reading, but it’s true that people’s newspaper readership is highest when you’re younger. It’s a myth that people start reading when they’re older.”

Local media: A stimulating discussion? Your ideas needed

Last week the National Union of Journalists (NUJ) sent an eight-point plan to new culture secretary Ben Bradshaw as an economic stimulus package for the UK’s local media.

In summary:

  1. Reform of cross-media ownership rules with a strengthened public interest test;
  2. Hard and fast commitment to ring-fence licence fee funding for the BBC;
  3. A levy introduced on commercial operators who benefit from quality public service content – including local news – but do not contribute to its production;
  4. Tax breaks for local media who meet clearly defined public purposes;
  5. Tax credits for individuals who buy quality media;
  6. Direct support to help establish new genuinely local media organisations;
  7. Strategic use of central and local government advertising;
  8. Support for training opportunities that open access to journalism

The proposals come ahead of the long-awaited Digital Britain report, part of which will make new suggestions for local media ownership models and provision.

Both, of course, come on top of a select committee inquiry into local media, countless pontifications from media commentators (ourselves included) and lobbying by industry groups of Bradshaw’s predecessor Andy Burnham.

Reactions to the NUJ’s suggestions from a range of industry representatives are featured below – Journalism.co.uk wanted to gauge the feeling on the ground, so to speak (feel free to leave more comments below or email laura at journalism.co.uk).

Having spoken to Society of Editors executive director Bob Satchwell as part of this process, one thing is clear: new ideas are needed to support newsgathering at a local level, whatever shape or platform it takes.

But with the current level of pressure on existing local news providers, it is short-term answers that are needed, says Satchwell:

“While we’re waiting to create new models to deal with new media landscape the existing reality may be so seriously damaged that it may be too late to apply those complex solutions.”

Here are some reactions to the NUJ’s proposals – what’s the next step?

Firstly starting with a comment left on our original post by James Goffin on levies for aggregators:
Presumably ‘A levy introduced on commercial operators who benefit from quality public service content – including local news – but do not contribute to its production’ is aimed at people like Google, but why leave it there – and why only in one direction?

If this is genuinely aimed at supporting local media (and not just shoring up the BBC, which tends to be the NUJ line nationally) then why shouldn’t the corporation be charged when it ‘benefits’ from stories it has followed up from the local press? (Or blogs for that matter).

And much as I enjoy the idea of claiming back my Private Eye subs against tax, I can see it being as effective in stimulating the economy as the VAT cut.

Give them some credit for at least trying; pity most of it is nonsense.

Tom Calver, a communications officer for Blackburn with Darwen County Council, on defining ‘quality’ and a plan for mutually owned local newspapers:
Point 7 calls for us to consider ‘quality journalism’ when we place ads, which puts those of us in council comms in the unenviable position of having to decide what constitutes ‘quality’. Does the NUJ really think we should be doing that? In any case, there is only one local paper here, so I don’t have any choice in which title to use anyway.

What guarantee is there that ad spend would really support quality journalism, rather than just boosting profits while the newsroom is still run down?

I’m also slightly confused as to what’s meant by “identifying appropriate targets”. Generally speaking, my targets are groups of local people. If a local paper is a good way to reach them, I’ll use it. If it’s not, then I’d be wasting taxpayers money, and failing to get the message to the right people. So is the suggestion that only people who read the local paper are appropriate targets for any campaign?

Or is the suggestion that ‘appropriate targets’ are ‘deserving’ newspapers which should be supported in some sort of charitable way? I’d understand that if local papers were not-for-profit with a clear commitment to good journalism and informing local people, but they’re owned by large groups who will look after the bottom line long before they look after quality journalism.

The NUJ just has not gone far enough. It is asking for more money to be chucked at the same failing model, albeit with some loose guarantees about quality from the same groups that have cut back in newsrooms. That might slow the decline, but it won’t turn things around.

How about mutual ownership for local papers? Newspaper staff, local people and those who support quality journalism could all be members. A constitution could guarantee day to day editorial independence, but the editor would answer to a board elected from the membership, which would set parameters for coverage, monitor quality and ensure investment in training.

That sort of organisation could then benefit from tax breaks and have access to funds supporting community development. With a clear duty to improve local coverage, it would probably get back some of the lost readers (and so make itself a more appealing advertising channel for public services!).

Rick Waghorn, ex-regional newspaper journalist and founder of MyFootballWriter.com on practical problems:
I think it’s all very well intentioned, but as ever the devil will be in the detail and the ‘how’ any of this is likely to work…

Or, indeed, who is going to have the political will/leverage to ensure any of this is adhered to.

Tax credits? Who adjudicates on the ‘quality’ assessment panel?

Direct support for ‘genuinely’ local media organisations? How? When? Via whom? Ofcom?

Strategic use of local and central government advertising is spot on – but that can start happening now. But again who is charged with making the ‘assessment’ that it is ‘quality’ journalism?

With Tom Watson out of government, Ben Bradshaw presumably given 10 days to master his new ‘brief’ before the publication of Digital Britain, I don’t see anyone with the drive or the will to oversee this – not whilst the Brown government is so fatally weakened.

Alas, I fear it’s going to be every man, woman and under-fire journalist for themselves for the foreseeable future – and the only people that are ever going to come to our rescue are ourselves.

Former editorial director for a UK regional newspaper group on media ownership problems:
My own concerns would be about possible loss of independence that could come with subsidy.

The cut backs in the industry are already leaving gaps. It might be better to see who and what steps in to fill the vacuum. [More emphasis on new media models – Ed]

On cross media ownership, take a look at Guardian Media in Manchester where it has already happened with TV, radio, web and newspapers under one roof. It has not been a success.

Comment from Dan Mason, director of Dan Mason Associates and former newspaper group managing editor, on journalism enterprise:

Full marks to the NUJ for keeping the ball rolling after the departure of Andy Burnham. I’m delighted to see the appalling lack of support for media innovation and enterprise included (this would top my list), as well as the need to focus on better media training.

My big concern is that trying to define something as subjective as ‘quality journalism’ as a cornerstone of any plan renders it impotent from the start, especially when the suggested criteria includes demands on media companies that are impossible to regulate, like maintaining paginations.

If this keeps the dialogue going and pressure on this government to act, great. But, if Lord Sugar has anything to say about it, ministers will need to focus on what can be achieved, by when, for what cost.

More from Dacre: The Daily Mail editor on Max Mosley and ‘Flat Earth News’

Daily Mail editor Paul Dacre has made his thoughts about Justice Eady, the Human Rights Act and the Max Mosley privacy case against the News of the World pretty clear since giving his Society of Editors speech last year, but today he was given the chance to follow up on Mosley’s own comments to the commons select committee on press standards, privacy and freedom.

(And have his say he was most definitely going to – reminding the committee several times of the length of time they’d given Mosley to speak, until one member asked whether he felt he was being treated differently?)

“Mr Mosley, when he gave evidence to this committee, I was very surprised at the soft time you gave him,” said Dacre.

“For Max Mosley to present himself as a knight in shining armour, proclaiming (…) sanctimonious, self-righteousness is almost a surreal inversion of the normal values of civilised society.”

It’s ‘a bit like the Yorkshire ripper campaigning against men who batter women’, he added.

The ruling against the News of the World and in favour of Mosley made the government’s stance on brothels and prostitution problematic, he said.

While brothels are seen by the government as ‘unacceptable and totally wrong’ and requiring a law to prosecute the people that run them, ‘Justice Eady has said Mosley’s behaviour is merely unconventional not illegal’, said Dacre.

“One legitimises the other,” he said.

The Daily Mail would not have broken the Mosley story, because it is a family paper, he said, even if it had ‘fallen into the paper’s lap’ as one committee member suggested. However, Dacre said he would defend the NOTW’s right to publish it.

Nick Davies

Today’s hearing was also a chance for Dacre to respond to claims made by journalist and ‘Flat Earth News’ author Nick Davies at a committee session on Tuesday.

Summised by the committee chair, Davies said the Daily Mail was characterised by a level of ruthless aggression and spite far greater than any other newspaper in Fleet Street.

“Davies is one of those people who sees conspiracy in everything. Like many people who write for the Guardian he believes he is the only one who can claim the moral high ground,” said Dacre.

“The book doesn’t do himself or our industry any justice.”

The book, he added, had been written ‘without the basic journalistic courtesy of checking the allegations concerned’.

Dacre accepted that there is some ‘churnalism’ of press releases at a provincial and national level – driven largely by poor finances and lack of resources, but said he refutes the charge of the Daily Mail.

“I’d suggest the Daily Mail is both famous and infamous for taking Whitehall and government press releases and going behind them. Certainly our reporters when they get freelance copy make their own inquiries and take them further,” he said.

“Our spending on journalism today is as great as ever, despite the recession. Mr Davies makes a valid point about some areas of the media. I think strong areas of the media, including some of our competitors, are not guilty of this charge.”

Society Of Editors: Industry bodies send action plan to Andy Burnham

UK newspaper industry groups, the Society of Editors and the Newspaper Society, have sent a list of points of action to culture secretary Andy Burnham.

The points include looking at ways to prevent Google profiting from third-party news content and investment of public funds in media training.

Reporting restrictions: who can access them?

As reported on the main site, and as I commented previously on this blog, reporting restrictions which – if broken – would contravene the British Contempt of Court Act, seem increasingly irrelevant.

My own experiences in trying to access the reporting restrictions are perhaps a case in point. Since posting the earlier blog item on the Baby P case, we have had comments posted to this blog which we immediately suspected would contravene the reporting restrictions.

I decided to ring the Old Bailey to find out what they were. Firstly, being put through to the press room by error led to a bizarre encounter with someone (a maverick journalist?) who, extremely rudely, told me ‘you don’t pay’ so ‘why should I send you them to you’, suggesting that I put £50 in an envelope to access them.

His identity remains a mystery (he told me he had forgotten his name before hanging up). I then called the correct department who asked me to send my request by fax. After another couple of stages in which I had to confirm my status as a journalist, I finally accessed the material.

Now I know, for certain, that many of the blog comments we deleted could have seen us prosecuted under the Contempt of Court Act 1981, had we published them. The restrictions themselves forbid me to go into anymore detail than that.

The point here is that bloggers who write about Baby P have no way of accessing the reporting restrictions and therefore no way of knowing whether comments are libellous in breach of the Contempt of Court Act, or not.

When I asked the executive director of the Society of Editors, Bob Satchwell, about educating the general public about Contempt of Court he did not consider it a priority, suggesting that any policing of the internet was something of a lost cause.

But, nevertheless, before (that’s if they do) reforms come in, we have a tricky predicament. Surely, as an intermediary measure there’s a need for anonymised reporting restrictions which would explain to bloggers, social network users and citizen journalists why they can’t print certain details.

After all, journalists – on the whole – understand the need for protection of fair trials. Isn’t it time to explain things better to untrained online publishers?

Naming Baby P is not about giving into a Facebook campaign

Naming Baby P and his mother is not about giving into a hysterical Facebook campaign group; this is about confronting the reality of the online age.

I can’t link to it here, because it would be breaching reporting restrictions, but I know Baby P’s name, the baby’s mother’s name and the name of her partner.

So does anyone with even a little bit of Google cache savvy about them: it’s on a BBC report from 2007. Google cache preserves a page even if, as the BBC has done, original articles have been removed.

As the Independent reported, Facebook groups have published the details, despite the court order not to.

My argument is not about revealing the names for justice, it is about having a law which can actually be enforced.

If it had been reported abroad, on non-UK websites, they would be not be held accountable under the UK Contempt of Court legislation. Court orders, such as the one in this case protecting the names of the defendants, are simply not feasible in the web age.

I believe that whatever ensures fair trials without prejudice, protects the innocent people involved in the case (other people connected or in the family, for example) is necessary, and if keeping the names secret does that, then that should be done: I certainly won’t be joining any Facebook group to force their disclosure.

But it should be done in such a way where they really are secret, which has not happened in this case:

Jason Owen’s name is known; the mother’s name has also been previously published and is reachable with a quick search; the baby’s photograph is in the press.

One of the Facebook groups has a description reading: ‘For sum [sic] reason the press have seen it fit not to reveal the sick people who killed this poor helpless child.’

The press has not chosen to keep quiet (they certainly would print the names if they could); they are bound by law not to. But what happens when the wider community who have not been taught about reporting restrictions and contempt of court choose to publish, using blogs and social network sites?

I imagine that most people in that community, and wider geography, knows who the family are. Last night’s BBC Panorama showed that the research team were able to access things the mother wrote on social networking sites.

Yet the names cannot be disclosed by the British press without contravening the Contempt of Court Act. This means that disclosures are made through people who aren’t necessarily so concerned about, or even think about, media ethics or face any kind of editorial process.

As I reported in September, Bob Satchwell from the Society of Editors believes the legislation is out of date and redundant, as do many others.

Orders, such as those under section 11 of the Contempt of Court Act 1981, for example, allow a court to ban publication of specific information, in addition to statutory reporting restrictions. But how on earth to enforce this in an online world?

This is starkly proven in the case of Baby P.

It’s time to readdress our laws, as Satchwell has urged the Attorney General, and make trials really fair.

Postscript: I’ve just found Martin Belam’s blog post, which makes a similar point, and also focuses on the ‘sheer scale of useage of the internet’ in the UK as compared to 2000 when Victoria Climbié case was reported, for example.

SoE08: Mail Online’s Martin Clarke on newspaper web metrics

Following his comments to the Society of Editors (SoE) conference on the meaningless of monthly unique users stats for newspaper website advertisers, Martin Clarke, editorial director of Mail Online, spoke with Journalism.co.uk about what improvements are needed for web metrics:

SoE08: Younger voices at the Society of Editors conference

It made a nice change to hear from some multimedia journalists working at the frontline of the industry in the training session at the Society of Editors (SoE) conference today.

Ruth Barnett, a multimedia producer for Sky News, described how the industry had changed between starting her journalism training in 2005 and graduating a year later.

“I’ve been able to adapt to working in a multimedia, multi-platform way because this is precisely how I consume news myself,” she explained.

“I understand that not everyone in a newsroom can work in this way – I need experience of other journalists in the newsroom.”

Fellow panellist and multimedia reporter with the Western Morning News, Jane Omara, was initially trained as a web journalist and has been given training by her employer in more traditional skills such as media law and shorthand.

She explained to Journalism.co.uk that there was still ‘room for maneouvre’ for trainees when it came to learning new digital skills:
