It’s old-fashioned journalism from the bunker and there’s more to come, says Telegraph

So who wants the films rights to MPs’ expenses? It’s on a far less grave subject, but maybe it will be like the 9/11 films; the aftermath still permeating society, when the scripts are sold and production started. The next general election may not even have happened. Gordon Brown could still be Prime Minister. Just.

Or perhaps (Sir? ‘Lord’ is less likely given the target) Will Lewis’ memoirs will have been on sale for a while first, before the 21st century’s equivalent of ‘All the President’s Men’ is released, to allow the dust to settle.

Whichever way, this archetypal British plot is the stuff of a (Working Title, maybe) director’s dream; even if the journalism itself is markedly not Watergate, as most hardened investigative hacks and other journalists at rival titles are quick to point out. The gate of significance in this story is the one at the end of the second home’s garden path. No Deep Throat, just Deep Pockets.

A small group of privileged Telegraph journalists has been embedded from early till late in what’s apparently known as ‘the bunker’ – a room separate from the main newsroom, away from the ‘hub and spokes’, away from the Twitterfall graphic projected on the wall – sifting through the details of thousands upon thousands of supermarket, DIY store and restaurant receipts and other documents.

It’s got all the ingredients for the heroic hack flick: the furtive deal with the middle man and the original whistleblower, for an undisclosed sum (no doubt to be revealed in Lewis’ or possibly Ben Brogan’s memoirs), at one point rumoured to be £300,000.

While this whole expose – the ‘Expenses Files’ as the Telegraph first called it – is most definitely built on a film-like fantasy, it is grounded in career-breaking political change, and last night’s audience at the Frontline Club for a debate on the paper’s handling of the stories, got a little insight into the process; a rare chance, as the paper has mainly been very quiet on just how it’s done it.

The ‘consequences were massively in the public interest,’ argued the Telegraph’s assistant editor, Andrew Pierce, who popped up on BBC Breakfast news this morning as well. “It was brilliant, brilliant old fashioned journalism (…) at its finest.

“It’s so exciting – you were aware you had stuff, it was going to change things, and boy it has…

“Of course it’s been terrific for the circulation – we’re a newspaper and we’re there to make sales.”

According to Pierce, 240 broadsheet pages covering the story have been published so far.

“So far we’ve published one correction: we got a house mixed up. I’d say in terms of journalism that ain’t a bad ratio.”

That was disputed by one member of last night’s panel, Stephen Tall, editor-at-large for the Liberal Democrat Voice website; he’s unlikely to get a cameo as it would rather spoil the plot.

Tall’s complaint was that three stories on Liberal Democrats have been misrepresented in separate stories and received insufficient apology; something Journalism.co.uk will follow up on elsewhere, once we’ve moved on from this romanticised big screen analogy.

Back to the glory: Pierce described how journalists from around the world had been to peek at the unfolding scene of action – they’ve had camera crews from Turkey, Thailand and China, in for visits, he said.

There’s a ‘sense of astonishment’, he added. ‘They thought quaint old Britain’, the mother of all democracies, ‘was squeaky clean.’

The story, Pierce claimed, ‘has reverberated all the way around the world’. “We actually are going to get this sorted out. Were MPs really able to set their own pay levels? Their own expenses levels? And it was all tax free.”

‘Old-fashioned journalism lives on’ has become the war cry of the Telegraph and its champions, in defence of the manner in which it acquired and dealt with the data.

For raw blogging it is not. Any CAR is kept secret in-house. Sharing the process? Pah! This is as far away from a Jarvian vision of journalism built-in-beta as you can imagine. While other news operations – the Telegraph’s own included – increasingly open up the inner workings (former Telegraph editor Martin Newland’s team at The National in Abu Dhabi tweeted live from a significant meeting yesterday morning) not a social media peep comes from the bunker till the paper arrives back from the printers.

There might be little teasers on the site with which to taunt their rivals, but for the full meaty, pictorial evidence it’s paper first, online second. Rivals, Pierce said, have to ‘wait for the second edition before they rip it off’.

Nobody has it confirmed how much they officially coughed up for the story – ‘we don’t use the words bought or paid,’ said Pierce. Though last night’s host, Guardian blogger and journalism professor Roy Greenslade, twice slipped in a speculative reference to £75,000, Pierce refused to be drawn.

“Fleet Street has existed for years on leaks,” said Pierce, as justification. “We will stick to our guns (…) and not discuss whether money changed hands.”

Enter the hard done by heroine of the piece: Heather Brooke. Much lauded and widely respected freedom of information campaigner, she and other journalists – one from the Sunday Telegraph (Ben Leapman); one from the Times (Jonathan Ungoed-Thomas) – did the mind-numbingly boring hours of Freedom of Information requests and tedious legal battles over several years, only to lose the scoop to a chequebook.

Will she get a part in the government-destroyed-by-dodgy-expenses film? If Independent editor, Roger Alton, was casting she certainly would. In fact, she deserves a damehood, he declared last night.

A member of the audience asked whether Alton would have paid for the information himself if he had had the chance. Unlike his last foray to the Frontline, the Independent editor knew he was being filmed this time. A pause for ethical reflection before he answered, then:

“We’ve barely got enough money to cover a football match for Queens Park Rangers. Take a wild guess! Any journalist would cut off their left arm and pickle it in balsamic vinegar!”

That’s a yes then, we presume.

Apparently, Sun editor Rebekah Wade turned it down after being told there wasn’t much chance of a Jacqui Smith style porn revelation or a cabinet resignation. “She asked ‘would this bring down a cabinet minster?’ And she was told it wouldn’t,” claimed Pierce. How wrong the data tout(s) were about their own stuff.

More embarrassing for the Telegraph, though Pierce said he knew nothing of it, was Brooke’s revelation that the Sunday Telegraph had refused to back their man financially, a case which Brooke, Leapman and Ungoed-Thomas finally won in the High Court – the judge ordered disclosure of all receipts and claims of the 14 MPs in original requests, along with the addresses of their second homes.

Update: Ben Leapman responds on Jon Slattery’s blog here: “I never asked my employer to pay for a lawyer because I took the view that journalists ought, in principle, be able to go to FoI tribunals themselves without the barrier of having to pay. I also took the view, probably rather arrogantly, that in this emerging field of law I was perfectly capable of putting the arguments directly without a lawyer.” Leapman was represented by solicitor advocate Simon McKay ‘very ably for no fee’ in the High Court, he writes.

Publication of all MPs’ expense claims are now forthcoming, after redaction (‘a posh word for tippexing out,’ said Pierce.) In July 2008, ‘parliament went against the court by exempting some information – MPs’ addresses – from disclosure,’ the Guardian reported.

Now, for a name for our blockbuster. ‘The Month Before Redaction‘? ‘Bunker on Buckingham Palace Road‘? ‘646 Expense Forms and a Re-shuffle‘? I can predict a more likely tag line at least, the now all too familiar: ‘They said they acted within the rules’.

The ending to this expenses epic is not yet known, but there won’t be many happy endings in Parliament. Pierce promises more stories, with no firm end date, but unsurprisingly, didn’t give any hint of what lies ahead. Could an even bigger scoop be on its way? Who’s left?

Richard Sambrook: John Birt criticised ‘He Said She Said’ formula 34 years ago

Prompted by Jay Rosen’s recent critique of the ‘He Said She Said’ news formula, Richard Sambrook, director of BBC Global News, offers his own take on balanced reporting on his blog.

Sambrook ‘agrees with the thrust’ of Rosen’s argument, ‘but was left uncomfortable’ for several reasons, outlined in his post.

Most interesting, is Sambrook’s reference to a critique against the formulaic approach of British TV news, made 34 years ago by John Birt, later director-general of the BBC, and Peter Jay, a Times columnist and later economics editor of the BBC. They called it ‘bias against understanding’. Birt’s argument shaped his later strategy:

“In the late 80s, instead of interviewing those caught up in the news, specialist correspondents would be interviewed to explain the significance of an event or a report. It was highly successful, building the reputation of BBC News as a quality, intelligent, authoritative service. It’s a model which persists to this day.”

New appointment: Ayers is made regional web publishing director at Trinity Mirror Regionals

A week with particularly brutal cuts across UK regional media, but news of a new digital appointment comes from Trinity Mirror this morning:

Richard Ayers has been appointed regional web publishing director for Trinity Mirror Regionals.

“In this key position Richard will work closely with the regional teams across the division to implement digital best practice and develop content and online services to drive usage, audience and online revenues across the regional network,” a release from the group said.

“Richard has a first class background in online publishing and I am delighted to welcome him to the team,” said Chris Bunyan, digital director of Trinity Mirror Regionals.

“The audience for our regional sites has increased by over 30 per cent year-on-year to around 5.5 milllon users a month. Richard’s experience and expertise will strengthen our digital team and will ensure we continue to deliver and drive compelling online user experiences for this growing audience across our regional websites,” Bunyan said, in the release.

Ayers career includes ten years at BBC News online, in ‘a number of senior digital roles;’ he was ‘portal director’ for Tiscali.co.uk, and more recently he was the managing director of a digital production agency, Magic Lantern.

The Trinity Mirror release also announced that Shaun Collins has been appointed as digital recruitment director, a role which sees him focus on ‘driving digital recruitment products and their performance’.

MST response to Press Complaints Commission letter: “Suggestion of bad faith is entirely unjustified,” says Salz

Anthony Salz, who is chair of the Independent Press Review Group and also on the Board of the Media Standards Trust, has replied to a letter from the chair of the Press Complaints Commission, Sir Christopher Meyer, (February 19, 2009), which made criticisms of the MST review calling for reform of UK press regulation, published on February 9, 2009.

Wednesday 11th March

Dear Sir Christopher,

Thank you for your letter of 19 February.

We will, of course, take it into account in the second stage of the review. In the meantime I feel I should reply to some particular assertions you make about the report.

1 Bad Faith

You suggest that the review is not being undertaken in good faith because we did not ask you to contribute to what you describe as a strident report. This suggestion of bad faith is entirely unjustified. I also strongly object to your personalised attack on the Director of the Media Standards Trust (MST).

The MST is an independent registered charity. It operates much like any other think tank and receives funding by donations from Foundations and individuals. This has included grants from the Esmée Fairbairn Foundation, the Nuffield Foundation and the Joseph Rowntree Charitable Trust. It was set up to foster high standards in news on behalf of the public.

We state clearly in the report that it represents Part 1 of a two-stage review. The first part is an analysis of the current system of self-regulation (including, apart from the PCC, the legal cases, issues concerning user-generated content, the Motorman investigation, the challenge to achieve consistency of regulation and governance of regulators). This is based on publicly available information and on the findings of a recent YouGov poll that the MST commissioned.

No-one was formally consulted in the first stage. The analysis in Part 1 was always intended to start a debate and provide a basis from which we could consult widely. Consultation with the PCC alone in advance would have been inappropriate. We felt it important that Part 1 should not be influenced by a key body with a particular interest. The PCC has shown that it is, of course, well placed to obtain media coverage for its reply.

All members of the Review Group feel that there is a need for change and that the report facilitates a debate. We are keen that the PCC, those who have been involved with it and its stakeholders are part of that debate.

2 PCC Statistics

You claim that the report “fundamentally misinterpret[s] the PCC’s statistics”. Your letter cites one statistic in support of this claim – that less than 1 in 250 complaints is upheld in adjudication. This statistic is not in fact in the report, though it was mentioned by Sir David Bell on air. It derived from your 2007 Annual Report. Page 25 states that the PCC adjudicated in 32 cases of which 16 were upheld against newspapers, from a total of 4,340 complaints (equating to 1 upheld adjudication for every 271 complaints).

As your letter illustrates, the PCC’s figures and terminology are somewhat difficult to follow. The explanation in your letter is helpful, as is the recent addition to your website “the Facts behind the Figures”. Both show why readers of your published materials have had a hard time understanding what is going on. However you explain your terminology, 32 adjudications from 4,340 complaints is to me a small number of adjudications.

Our report acknowledges that you dispute the value of using adjudications as a measure (on page 28). We feel, nevertheless, that the number of adjudications is important – since it is the only public sanction the PCC has. Others have also argued for their importance. Professor Greenslade last year, for example, told the House of Lords Select Committee that “The failing of the PCC is the failing to adjudicate often enough”. Without adjudication, he went on to say, “newspapers escape censure and punishment too often when they actually at the final hour do some kind of deal to get themselves out of a mess, when they breach the rules as it were”.

3 Inaccuracy

You stated on air, and repeat in your letter, that the report has many inaccuracies. In addition to the 1:250 point above, you cite only the statement that the ASA was modelled on the PCC. You are right: it was in fact modelled on the Press Council, the predecessor to the PCC (Richard Shannon, A Press Free and Responsible, p.13). The substance of the point still stands but we will, of course, correct the reference.

4 2007 Select Committee

In your letter you criticise the report for failing to mention the Select Committee on Culture, Media and Sport, 2007. You suggest that this Select Committee makes the PCC accountable. The CMS Select Committee has led important examinations of aspects of self-regulation although it is not constituted to hold the PCC to account. Select Committees are held at irregular intervals and the Committee ‘chooses its own subjects of inquiry’ (from its website). The 2007 Select Committee, for example, focused closely on the issues raised by the harassment of Kate Middleton, Clive Goodman’s conviction, and Operation Motorman.

Reference to the 2007 Select Committee report might have been useful. It expressed concern about the ‘complacency of the industry’s reaction to evidence presented by the Information Commissioner showing that large numbers of journalists had had dealings with a private investigator known to have obtained personal data by illegal means’ (p.3). It went on to say ‘we are severely critical of the journalists’ employers for making little or no real effort to investigate the detail of their employees’ transactions. If the industry is not prepared to act unless a breach of the law is already shown to have occurred, then the whole justification for self-regulation is seriously undermined’ (p.3).

It said that the current form of press self-regulation offered more protection than relying exclusively on the law. This is important and should indeed be a purpose of self-regulation. It noted (as we do in our report) that the Press Complaints Commission ‘has evolved’, and said that it had ‘become a more open body which provides a better service to complainants’. However, it also made clear that ‘This Report is not a broad look at whether the system of self-regulation as currently operated by the industry is the best way to curb unjustified practices and punish those who publish material obtained in such ways. To reach a properly informed view on such a complex subject would require more time and more evidence’ (p.5).

The same Select Committee concluded its Summary by saying that ‘The system for regulation of the press raises serious and complex issues which may merit a broader investigation than we have been able to undertake here. We believe that this is a subject which… deserves careful examination in the future’ (p.4).

These statements, taken together, both acknowledge positive changes in the PCC and support the case for a broader review of press self-regulation.

5 Some Substantive Questions

You say the PCC must give priority to the forthcoming hearing of the Select Committee. After this, I would be interested to meet with you and your colleagues to hear the PCC’s views on some of the substantive questions that are raised about future press regulation. For example:
•    Is it sufficient that the PCC’s constitution essentially sets it up only as a complaints-handling body?
•    Would it not be preferable to avoid having working editors on the Press Complaints Commission (as distinct from those who have worked in journalism)?
•    Would the position of the PCC as a regulator be assisted if it could be given greater powers to ‘enforce’ its decisions for the benefit of a complainant, making it more ‘competitive’ with the legal route?
•    Would you consider that there should ideally be some structure for independent appeal against a decision made by the PCC?
•    How might the PCC change in order to meet growing expectations of public accountability (expectations that are fed by the press)?
•    Why should the PCC not be covered by the Freedom of Information Act (assuming that it would be possible to protect the privacy of complainants who wanted it)?
•    Is there any reason why the PCC should not make its sources of revenue transparent?

We have been clear that our first report is a starting point for debate. Though I welcome your response, I do not accept your characterisation of our report.

Peter Horrocks’ new job as BBC World Service Director

So finally, and after some (inaccurate) speculation the new head of BBC World Service has been announced. Peter Horrocks leaves his role, as head of the BBC’s multimedia newsroom, to replace Nigel Chapman, as director of the BBC World Service. Chapman is off to become CEO of international child development agency, Plan International. Horrocks wasn’t available for any more interviews today, but Journalism.co.uk will chase for more information soon, to find out what Horrocks hopes to bring to his new role.

NiemanLab.org: ‘Why news orgs can police comments and not get sued’

NiemanLab.org publishes a video of David Ardia, director of the Citizen Media Law Project at Harvard, at a conference of New England newspaper editors and also provides a full transcript. He explains Section 230 of the Communications Decency Act (CDA 230) and ‘how it provides wide-ranging immunity to web-site publishers for what goes on in their comments,’ the NiemanLab reports.

Evening Standard skips over error in BBC appointment gossip

The paper’s ‘Londoner’s Diary’ column had speculated that the new World Service director job, advertised internally, was being kept open for the BBC’s News Director Richard Sambrook, allegedly annoying ‘ex-BBC types’.

Sambrook was quick to correct it on his own blog: “I’m not a candidate for the job, because … it reports to me and I will be deciding who gets it.”

The Londoner subsequently corrected it like this, omitting to mention where the ‘fears’ had originated:

“There were also fears that the BBC’s Director of Global News, Richard Sambrook, was said to be eyeing up the post himself and how he would have been a shoo in for the job. The BBC press office hotly denied my suggestion that the post was being kept open for Sambrook, claiming that as Director of Global News, the new Director of World Service would report to him and that Sambrook will be involved in appointing someone to the job himself.”

Miller-McCune: Deep throat meets data mining

The digital revolution could help halt the decline in investigative journalism, thanks to a “new academic and professional discipline” known as ‘computational journalism’, writes John Mecklin in Miller-McCune.

“On a disaggregated Web, it seems, people and advertisers simply will not pay anything like the whole freight for investigative reporting. But [James] Hamilton [director of the DeWitt Wallace Center for Media and Democracy at Duke University] thinks advances in computing can alter the economic equation, supplementing and, in some cases, even substituting for the slow, expensive and eccentric humans required to produce in-depth journalism as we’ve known it.”

Sir Christopher Meyer’s speech in full: plea to publishers to aid PCC

As reported on the main page, Sir Christopher Meyer will tonight urge publications to support the Press Complaints Commission (PCC) in its role, which he emphasises is still relevant in light of online developments and recent privacy issues. Here is his speech in full, courtesy of the PCC’s website:

“It is always a pleasure to be in Manchester – a city with a vibrant media which I have visited more than any other in England during my time chairing the PCC. It was in this very room five years ago that I launched the first of our Open Days: public meetings in the towns and cities of the UK aimed at making the PCC as accessible as possible. Then, as now, we were given all possible support by the Manchester Evening News and Paul Horrocks. One of the most respected and innovative editors in Britain, Paul was also an outstanding member of the PCC for four years.

It has always been my ambition to hold a full meeting of the PCC outside London. It is vital to get over the message that we are not a body shut away inside a metropolitan bubble, dealing with the complaints of celebrities, royals (and near-royals), and politicians. The reality is far different. We exist for all the citizens of the United Kingdom; and of the thousands who come to us for help and advice, over 90 per cent lay no claim to celebrity whatsoever.

So, tomorrow’s meeting of the PCC is an historic moment in the 17-year life of our organisation. My colleagues from the board, all/most of whom are present tonight, are the people who take the decisions under the Code of Practice: about where the public interest meets the individual’s right to privacy; what constitutes a significant inaccuracy; when payments for information can be made – in short, on how the UK’s newspapers and magazines should gather and report news in print and online.

Brand Republic: BBC to increase social media on sites, says Huggers
