As a Norwegian lawyer/litigator within the field of media law, I have in recent years acted as counsel for the Norwegian PB, NRK, who also covered Trafigura exstensively - and who disregarded the Britsh High Court injuntion.

I'm wondering when a UK-medium will challenge the censorship inherent in the injunction-system?

NRK did in 2005, by violating a similar secret injunction, banning NRK from broadcasting av documentary revealing illegal police methods in an on-going investigation. Although, of course, violating an injuntion is generally a criminal offence, as NRKs counsel I argued that a) the injunction was itself a violation of the ECHR article 10, and that b), if the courts agreed on that point, punishing the editor for violating the injunction, would be yet a violation of ECHR article 10 (ref, inter alia, mutatis mutandis, the Goodwin v. the United Kingdom case). Our case was successful, and as a general legal consequence, today it is virtually impossible to succeed in an application for an injunction against the media. Lesson: A llittle "civil disobedience" could maybe rid British media law of the injunction-censorship-monster...

Thankyou for sharing your insight. This is set to run and run, and with enough momentum the laws have to change - shocking.
